Metaphysics of Kanun: “To Move a Boundary Is Like Moving the Bones of the Dead”

Abstrakt:

Studie je věnována Kodexu Lekë Dukagjiniho (1933), který kodifikoval Shtjefën Gjeçovi na základě zvykového práva obyvatel horských oblastí severní Albánie. Studie navrhuje filozoficko-hermeneutický rámec pro interpretaci cti jako etického a metafyzického základu Kanunu. Prostřednictvím systematického čtení jeho dvanácti knih analýza zkoumá způsoby, jakými jsou vzájemně propojeny čest, besa (dané slovo), příbuzenské vztahy, majetek, hranice, spravedlnost, krev, rituál a vztahy k posvátnu. Studie uvádí vybrané principy Kanunu do dialogu se starověkými právními, filozofickými a náboženskými tradicemi, zejména s Chammurapiho zákoníkem, Starým zákonem a díly Platóna a Aristotela. Tvrdí, že zvyková pravidla upravující každodenní sociální vztahy nejsou prezentována pouze jako pragmatické předpisy, ale jako projevy posvátného řádu propojujícího individuální chování, komunitní morálku a transcendentní pojetí spravedlnosti. Z tohoto pohledu funguje čest jako princip, jehož prostřednictvím jsou artikulovány a udržovány sociální a metafyzické dimenze života.
